TERMS AND CONDITIONS
These Terms and Conditions govern the sale of goods by De Luca Family Food S.R.L., with registered office at in via Prima Strada 35, 35129 Padova - Italia VAT: IT05129610282 and owner of the website www.delucafamilyfood.com
By placing an order through the website www.delucafamilyfood.com, the Customer (the user) is deemed to be aware of the terms outlined in this document and through the purchasing procedure, and to accept the following conditions.
Receipt and acceptance of the order by us will be confirmed by sending an email presenting the order details. The message will reproduce all the data provided by the Customer, who is responsible for verifying its correctness. If for any reason the order cannot be accepted by De Luca Family Food S.R.L., this will be promptly communicated via email.
SITE REGISTRATION
In order to proceed with the purchase of products sold through the site, the Customer has the option to place the order as a guest or to register through the designated reserved area, providing truthfully and completely the requested data at the time of registration and accepting the Privacy Policy. The Customer is also required to keep and safeguard their access credentials and will be solely responsible for activities carried out on the site in association with their credentials.
PRODUCT PURCHASE
The Customer can purchase the products available on the website www.delucafamilyfood.com at the time of ordering.
It is understood that the image presented on the site in the product description section is for indicative purposes only and may not reflect the actual colors of individual products.
Prices are expressed in euros (€) and are inclusive of VAT. Shipping costs are not included in the price of each product and will be calculated based on the type of shipping chosen in phase no. 3 of the purchase confirmation. However, they will be summarized in phase no. 4 of payment.
Orders placed after 12:00 PM or on Saturdays, Sundays, or holidays will be processed on the next business day after the order date.
PAYMENT METHODS
All payments must be made at the time of ordering. We will not proceed with the preparation and shipment of the goods without receiving payment. The payment methods available to the Customer are indicated on the order page and include PayPal, Credit Card, Debit Card, Apple Pay, and Google Pay.
DELIVERY
De Luca Family Food S.R.L. offers two types of shipping that the Customer can choose from at the time of ordering, namely express delivery and standard delivery. Orders will be delivered to the Customer within the timeframes established by the selected delivery method at the time of ordering. Delivery times may vary and are subject to any problems due to postal delays or force majeure (e.g., weather conditions) for which De Luca Family Food S.R.L. will not be liable. If items are not delivered within the specified timeframe at the time of shipping selection, please contact our Customer Service via the ticket in the order confirmation email, indicating the problem encountered. Upon delivery, the Customer is required to check the status and number of packages received. In the event of a problem, the Customer must sign with a reservation and contact customer service via the ticket in the "Delivered Order" email.
RIGHT OF WITHDRAWAL
The Customer has the right to withdraw from the purchase in accordance with what is provided for by art. 52 of Legislative Decree no. 206/2005 without providing explanations or any penalty within and no later than 14 days from the receipt of the order. To exercise this right, the Customer is obliged to inform De Luca Family Food S.R.L. of their decision by contacting customer service via the ticket in the email of the placed or delivered order, indicating the intention to exercise the RIGHT OF WITHDRAWAL. The right will be applied exclusively for products that are returned intact, in their original packaging, and have not been opened. The refund will be made once the goods, once examined for any damage or tampering, are found to be compliant with current regulations. If anomalies are found, the refund will not be granted.
Exceptions to the right of withdrawal:
Pursuant to art. 59 lett. d) and e) of Legislative Decree no. 206/2005, the right of withdrawal is excluded in the following cases:
- Supply of goods liable to deteriorate or expire rapidly;
- Supply of sealed products that are not suitable for return for reasons of hygiene or related to health protection and that have been opened after delivery.
Therefore, the return of products purchased on the De Luca Family Food S.R.L. website will be granted only if the products are returned intact and without tampering by the withdrawing Customer.
RECEIPT OF NON-COMPLIANT PRODUCTS
In the event that the Customer has received non-compliant products due to damage, deterioration, or differences from those ordered, they must promptly inform De Luca Family Food S.R.L. via the ticket in the order delivery email. It is also requested to attach photographs indicating and showing the anomaly encountered. De Luca Family Food S.R.L. will take care of the request and communicate the outcome through the ticket. In the event of a request for replacement of products that have arrived incorrectly compared to what was ordered, the Customer must notify De Luca Family Food S.R.L. of the problem within and no later than 14 days, by contacting Customer Service via the ticket in the "Delivered Order" email.
De Luca Family Food S.R.L. will handle the request and communicate the outcome through the ticket.
De Luca Family Food S.R.L. reserves the right to verify the conditions for making a replacement.

TRADEMARK PROTECTION
All trademarks and distinctive signs, such as illustrations and photos, appearing on the website www.delucafamilyfood.com are the property of the Owner and are protected by the applicable laws. Any unauthorized use of the above will be punished in accordance with current laws.
